ALBUQUERQUE (KRQE) - A photo snapped on Central Avenue appears to show a woman with a baby nestled in a sling while she rides on the back of a motorcycle.
According to the guy who took the picture, it is indeed a child.
News 13 blurred the driver and passenger's faces because they were not cited.
The photo was taken on Central Avenue near Girard a few days ago then posted on Facebook where the outpouring of outrage came fast and furious.
"To me, it's a bad idea, very bad idea and dangerous," said Dee Candelaria after seeing the photo.
According to state statute, it is illegal to have a baby on a motorcycle for a few reasons.
"One, you're placing that child at risk ... you need to be responsible and you have to understand what's going on," Sgt. Emmanuel Gutierrez said.
There's also the issue of not having the child properly restrained.
While State Police cannot do anything about it now. Had their officers seen this on the road, that driver would have been pulled over, they say.
In the back and forth over the photo on Facebook, someone claimed the baby was actually a dog.
The photographer insists it was a baby. State Police said even if it was a dog, that's still against the law.
The photo has since been taken off the Facebook page where it was originally posted.
