Lawsuit planned over candidate's filing

SANTA FE (AP) - Secretary of State Dianna Duran says a dozen candidates, including Senate President Tim Jennings of Roswell, will be placed on the primary election ballot but a legislator plans a lawsuit challenging the decision.

Questions had been raised about the legality of the candidates' nominating petitions because they lacked the political district in which the candidates were running for office. State law requires that information.

Democratic Rep. Thomas Garcia of Ocate said Monday he plans a lawsuit to challenge the candidacy of Sen. Pete Campos, a Las Vegas Democrat who was among those facing questions about their petitions.

The attorney general's office advised the secretary of state that court rulings indicate that compliance with every technicality is not necessary for a nominating petition to be considered valid.
