ALBUQUERQUE (KRQE) - Minimum wage is headed back to court.

The New Mexico Supreme Court will hear the minimum wage case Wednesday afternoon.

A district judge ruled Tuesday that the minimum wage question includes several separate issues and so can not be voted on as a single question in the November election.

The group OLE wants to boost minimum pay here from $7.50 an hour to $8.50 in 2013.

It would also give a pay boost to tip workers.
