ALBUQUERQUE (KRQE) - A group of Albuquerque homeowners claim they have won the battle against a local gas station , but managers say hold on a minute.

For more than a year, people have protested outside a Smith's gas station on Carlisle and Constitution, because they say it makes their neighborhood dangerous.

Saturday they were not protesting they were celebrating saying that smiths air quality permit has been denied.

“This station is unsafe it affects our air quality and it's dangerous for so many different reasons,” Pat Toledo, with Summit Neighborhood Association, said.

But people were still filling up behind the peaceful protestors.

A Smith’s gas station manager says they are still working within their permit and that attorney's are still working on the issues that residents are complaining about.

The fight over the gas station has been going on for more than a year.
