ALBUQUERQUE (KRQE) - Just moments after an Albuquerque lawyer put a bullet in a stranger he had exchanged words with; police were on the scene at the downtown law firm with their lapel cameras rolling.
The cameras do not just catch the bizarre aftermath; they shed light on what led up to the shooting. How did a homeless man end up almost dying in front of a law office?
There are two very different versions of what happened and both are strange.
“Where you shot at man?” The officer asked on the video. “Where you shot at?”
Steven Biddinger, an admitted drug user, convict and homeless man was found laying on David "Chip" Venie's law firm's front porch in late August; shot in the thigh and bleeding badly.
“I am going to die,” Biddinger says to the cop. “I’m already fainting.”
While one cop tends to Biddinger, the other goes inside; both trying to get answers. Inside, Venie and his wife were recording everything on her cell phone, while two other employees were inside.
At one point cops let well-known defense attorney call his own attorney.
“Hey Ray, you are not going to believe this,” Venie said. “A guy came into my building, hassling me, threatening me, refused to leave and I had to shoot him. The police are here.”
So what led to this?
During a later interview of Biddinger at the hospital, he says Venie, who he had never met, told him he stunk as he walked past Biddinger on the sidewalk.
“I turned right around and said why don't you say it to me in my face man,” Biddinger told the cops. “He says you know what, come over here and I will shoot you.”
Biddinger says he followed Venie and they exchanged words both inside and outside the law office.
“He goes to his office, comes back with two 9's pumps them up. He says you better leave because if you come back in here I am going to shoot you,” Biddinger tells the cops. “I didn't raise a hand at him, I didn't flinch at him, I didn't go at him."
Something witnesses backed up, even telling cops Biddinger had no weapons. When the officer asked what Biddinger had in the bag they found at the scene.
“Miscellaneous stuff that I picked out of a trashcan, I was trashcan surfing man. I am hungry and I am homeless,” said Beddinger.
Biddinger admitted he was on a meth binge the night before the shooting.
Venie has been charged with aggravated battery.
Witnesses told cops Venie escalated the argument and even egged Biddinger on.
This is the only trouble Venie has had in New Mexico. Public records show he has been suspended twice by the New Mexico Supreme Court, once for antics he pulled while practicing in California and again for arguing and disrespecting a federal judge during a trial in January.
