Son charged with mother's crash death

RIO RANCHO, N.M. (KRQE) - A Rio Rancho man is facing charges from an alleged drunken driving crash that killed his mother.

Investigators say she wasn't the only victim. His son was also seriously injured.

On Thursday a grand Jury indicted Jonathan Madrid, 31, for vehicular homicide and child abuse resulting in great bodily harm.

Rio Rancho police say he was drunk when he turned left into oncoming traffic at the intersection of State Route 528 and Sundt Roads just before noon on Jan. 4 .

A pickup truck hit the passenger's side of Madrid's car where his 51-year-old mother, Francis Madrid, was sitting.

His 1-year-old son was buckled up in a car seat in the back seat. He was rushed to the hospital with serious injuries. Francis Madrid died at the scene.

Police collected a blood sample from the driver when he was at the hospital. They have not released his exact blood alcohol level saying that detail is pertinent to their case.  However, they will say it was higher than a 0.08, the minimum for presumed impairment, but lower than a 0.16, the threshold for being charged with aggravated DWI.

Madrid was arrested at his Rio Rancho home late Thursday. He is being held on a $25,000 cash-only bond.

Madrid's young son has recovered and is living with a family member.
