Paroled lawyer wants new fatality trial

SANTA FE (KRQE) - Carlos Fierro, the former attorney convicted of killing a pedestrian while driving drunk is asking for a new trial.

Fierro was sentenced to seven years for the death of William Tenorio, a pedestrian who was crossing the street in Santa Fe in November 2008.  During the trial he admitted to drinking at length with a State Police officer that night, and police later reported his blood-alcohol level as 0.21, three times the legal limit for presumed intoxication.

While Fierro is already on parole, he believes his case should be heard again.

Fierro's new attorney, Ray Twohig, has filed an appeal claiming Fierro's former attorneys failed to defend him properly.

He claims they didn't investigate enough, failed to challenge questionable actions by the police department and even failed to research jurors therefore failing to reveal the jury foreman had a criminal case pending against him that he failed to disclose.

Fierro's law license was suspended after his conviction.  He is now living in California.
