LOS LUNAS, N.M. (KRQE) - A shocking allegation first made in a civil lawsuit suit filed by a state prison inmate has grown into a criminal case against a former corrections officer.

A Valencia County grand jury has indicted former guard Capt. Kenneth Carrejo on four counts of rape for repeatedly assaulting a los Lunas prison inmate named Kenneth Morgan over a period of five months last year.

Morgan claimed he was able to collect a DNA sample during one of the attacks, which he hid and turned over to the FBI.

If convicted Carrejo, who is now retired, could face up to 48 years in prison.

Morgan's civil lawsuit against corrections is continuing.
