BLOOMFIELD, N.M. (KRQE) - An eight-time drunken driver in Bloomfield has been found not guilty of what would have been his ninth DWI.
Police say José Valencia crashed his vehicle on U.S. Highway 550 last December.
They suspected he was drunk, but officers say Valencia was complaining of soreness. So a State Police officer did not do a field-sobriety test.
The Farmington Daily Times reports a preliminary test showed Valencia with a blood-alcohol level of 0.13. But when it was recorded hours later at the jail, he registered under the legal limit of 0.08.
Valencia was acquitted Thursday.
