SANTA FE (KRQE) - A woman who drove drunk and killed a Santa Fe man will not go to prison at the request of the victim's family.
Margaret Garcia, 53, turned in front of 40-year-old Paul Bennett's motorcycle in August. Bennett, 40, could not avoid the collision and suffered fatal injuries.
Garcia's alcohol level tested 0.13, above the legal level for presumed impairment of 0.08.
At her sentencing for vehicular homicide Thursday, Bennett's family asked that instead of going to prison Garcia spend her time helping prevent others from drunken driving.
The judge sentenced her five years of probation.
Garcia will have to attend and speak at victim-impact panels, go to counseling, and she cannot drive.
