ALBUQUERQUE (KRQE) - The attorney for Levi Chavez, the former APD officer charged with murdering his wife , has asked for a change of venue.
Chavez is accused of shooting Tera Chavez in their Valencia County home in 2007 and making it look like a suicide.
Now Chavez' attorney has asked that the trial be moved to Sandoval County arguing that Chavez can not get a fair trial in Valencia County because of all the publicity.
Chavez is charged with first degree murder.
Prosecutors allege Chavez killed his wife because she was going to report him for insurance fraud.
Chavez maintains that Tera's death was a suicide.
