Accused pajama shooter has cancer

Scott Powell seeks medical attention not jail

SANTA FE, N.M. (KRQE) -
The man accused of shooting up a a speed van and a few days later leading police on a dangerous chase through Santa Fe wants to get out of jail because he has cancer and other medical conditions.

Scott Powell's lawyer argued that his client is sick and can't stay in jail. Attorney Dan Cron said Powell needs to be in some sort of medical facility instead of behind bars where he's been since Friday.

A judge refused to release Powell during his first appearance Monday afternoon. Powell is charged with felony assault, fleeing and criminal damage.

Although cameras weren't allowed in the courtroom, new police video was released of last Friday's high-speed chase through downtown Santa Fe.

"We got him! We got him!" exclaimed an officer in the dash camera video as they tried to corner Powell.

Just when police thought they have him trapped, Powell zips off. The video shows him speeding through construction zones and nearly knocking over pedestrians.

The chase happened after Powell was supposed to surrender for allegedly shooting a speed van last month while wearing a nightshirt. The chase ended at a Santa Fe doctor's office a short time later where Powell surrendered.

Monday police defended their actions

"This was an armed and dangerous person," said Sgt. Andrea Dobyns. "He was also making suicidal threats, so our officers made the right decision in pursuing him

Meanwhile Powell's lawyer says his client desperately needs medical attention.

"We're looking for a facility that can do basically a complete work up," said Dan Cron Powell's defense attorney. "If there are issues out there that are undetermined, we're going to figure out what they are so Scott can get some help."

The judge refused to release Powell from jail saying he's a danger to the community.

His bond is set at $55,000 cash only.

The judge told Powell she would consider having him put in a hospital of some sort, but his lawyer needs to find the right one first.
