ALBUQUERQUE (KRQE) - The Bernalillo County Sheriff's Sergeant, charged with pulling a gun in a road rage incident, has been ordered to surrender all of his weapons.
Witnesses said Alfonso Rodriguez put a gun to the neck of a 20 year old that was double parked outside of Horizon Academy West Tuesday.
Rodriguez says he used his wallet, not a gun.
He also says the other driver came at him with a pipe.
Rodriguez' lawyer asked the judge to drop the aggravated assault charge that did not happen.
Rodriguez is free on bail.
The sheriff's department has put him on desk duty.
