CLOVIS, N.M. (KRQE) - One of the men charged with the tragic death of a 10-year-old Clovis boy was attacked by the boy’s uncle just hours after arriving at the Curry County Jail.

According to the Clovis News Journal the Curry County Sheriff’s office says jail staff placed Noe Torres in a holding cell near the one occupied by the boy’s uncle, Richard Silva.

Authorities say Silva asked staff to use the bathroom and then began punching Torres as he passed by.  Torres was chained to a bench at the time but was not seriously hurt.

Investigators say Torres was part of a gang that fired several bullets into a home in September 2005 that killed 10-year-old Carlos Perez.

Torres was captured in Mexico in January and returned to New Mexico.

He’s been in state custody but was brought to Clovis for court.
