(CNN) - Punxsutawney Phil could be headed to court.
Ohio prosecutor Michael Gmoser has filed "charges" against the famed groundhog.
Gmoser says Phil promised an early spring - and he was wrong.
"This is an indictment. It is a criminal charge against Punxsutawney Phil. We're sick and tired of winter here and old Phil let us down. I think in Pennsylvania, they just want to laugh at us. So, we're trying to have the last laugh. There's an old saying that prosecutors can indict a cheese burger if they want to. Well, we're changing all that. We can indict a groundhog."
On the first day of spring, the Northeast was pounded with more than a foot of snow.
Gmoser says he is sick of it - and he wants someone to pay.
It's all in good fun, of course, and Phil's handlers are getting in on the joke as well.
